Claims filed against this manufacturer are moving forward in federal and state courts throughout the U.S. In February 2013, the plaintiff for the first Ethicon lawsuit to go to trial was awarded $7.75 million in punitive damages and $3.35 million in compensatory damages by a jury in New Jersey Superior Court who found that Johnson & Johnson failed to adequately warn doctors about the risks associated with the Gynecare Prolift pelvic mesh device. This case was brought by a 47-year old South Dakota nurse who was allegedly forced to undergo 18 revision surgeries to repair the complications caused by the Gynecare Prolift device she received.
In the punitive damage stage of the Ethicon lawsuit, Bloomberg.com reported that a forensic economics expert testified that Johnson & Johnson spends the equivalent of what it was ordered to pay the plaintiff in compensatory damages, $3.35 million, every 45 minutes on advertising and marketing.
This Ethicon lawsuit was one of 2,100 claims filed against the manufacturer pending in a consolidated litigation underway in Atlantic County Superior Court, N.J. More than 2,000 claims have also been filed in a federal litigation underway in U.S. District Court, Southern District of West Virginia.
