Ethicon Lawsuit Filed Over Gynecare Prolift in Texas Federal Court this November
A patient from southeast Texas filed an Ethicon lawsuit at the end of November over a device that allegedly caused her to suffer bleeding, stress urinary incontinence (SUI), dyspareunia and other injuries.
The plaintiff in this case, which was filed in the Eastern District of Texas, Texarkana Division on Nov. 30, 2012, was implanted with the Ethicon-manufactured Gynecare Prolift device to treat pelvic organ prolapse (POP).
She is not the only woman claiming to have been injured by the Gynecare Prolift, though. It was revealed in the company’s Answer to the First Amended Master Complaint in the federal Ethicon transvaginal mesh multidistrict litigation (MDL) last August that many Ethicon lawsuits had been named the Gynecare Prolift device in their claims. More than 1,400 federally-filed Ethicon lawsuits are pending in the U.S. District Court for the Southern District of West Virginia.
The Prolene Mesh/Prolene Soft Mesh, TVT Abbrevo, and TVT Exact, TVT-SECUR, TVT-Obturator, Prolift + M and the Prosima vaginal mesh devices are also at the center of Ethicon lawsuits.
Last June, the manufacturer alerted the public of its plan to discontinue the Gynecare Prolift Pelvic Floor Repair System, the Gynecare Prolift + M Pelvic Floor System, the Gynecare TVT Secur System as well as the Gynecare Prosima Pelvic Floor Repair System. In doing so, Ethicon asked the U.S. Food and Drug Administration (FDA) for 120 days to stop selling these products.
Transvaginal mesh manufacturers preparing to defend the safety and effectiveness of their devices in U.S. federal and state courts include: American Medical Systems, Boston Scientific Corp, and C.R. Bard Inc. Federal multidistrict litigations (MDL) overseeing transvaginal mesh lawsuits have been created in the U.S. District Court for the Southern District of West Virginia.
