Do I Have a Case for a Transvaginal Mesh Lawsuit?

You may have a case for filing a transvaginal mesh lawsuit if you suffered serious, life-altering complications following implantation of a vaginal mesh device to treat pelvic organ prolapse or stress urinary incontinence.  Injuries allegedly associated with the use of transvaginal mesh include:

  • Erosion through vaginal wall
  • Infection
  • Pain
  • Urinary problems
  • Bowel, bladder, and blood vessel perforation during insertion
  • Vaginal scarring
  • Chronic discomfort and pain
  • Pain during sexual intercourse

Transvaginal Mesh Lawsuit Allegations

Plaintiffs in transvaginal mesh lawsuits allege the products are defective and that the manufacturers knew their safety risks but failed to disclose them.   In July 2011, the U.S. Food & Drug Administration (FDA) warned that there had been a fivefold increase in reports of women suffering serious complications following transvaginal mesh procedures. The FDA also said complications following pelvic organ prolapse repair with vaginal mesh was not rare, a change from its original position.

The transvaginal mesh brands and products named in lawsuits  were approved by the FDA via the 510(k) clearance program, which does not require human clinical trials for a device if a manufacturer can show it is substantially equivalent to a product that’s already been approved by the agency.  In September 2011, an FDA advisory panel recommended that vaginal mesh used in the transvaginal repair of pelvic organ prolapse be reclassified as a high-risk medical device, which would make such products ineligible for 510(k) approvals.
