More American Medical Systems Transvaginal Mesh Lawsuits Heading to Trial in United States


Another set of transvaginal mesh lawsuits involving products manufactured by American Medical Systems, Inc. have been chosen for the federal litigation’s third round of bellwether trials.  Juries will begin hearing those cases in August, with the first of the third round going to trial on August 19th.  According to an Order filed on January 24th in the U.S. District Court, Southern District of West Virginia, a second vaginal mesh lawsuit chosen by the Court will serve as back up if the first selection can’t proceed at that time.

The U.S. Judicial Panel on Multidistrict Litigation’s (JPML) most recent case list indicates that more than 14,000 transvaginal mesh lawsuits had been filed against American Medical Systems in West Virginia federal court as of January 15, 2014. Each of these complaints alleges that America Medical Systems created and marketed defective pelvic mesh implants, which may have led to transvaginal mesh complications such as organ damage, mesh erosion, vaginal scarring, and other debilitating injuries.

First Federal Transvaginal Mesh Lawsuits Involving American Medical Systems to Go to Trial in April

It is hoped that the bellwether trials scheduled in the American Medical Systems litigation will help predict the reaction of juries in similar actions involving the company’s products. A Pretrial Order dated December 11, 2013 indicates that the proceeding’s first of round of bellwether cases are scheduled to start on April 7, 2014. Allegations of transvaginal mesh complications have led to the filing of tens of thousands of lawsuits involving dozens of surgical mesh devices used to treat pelvic organ prolapse and stress urinary incontinence, many of which are pending in other proceedings underway in the Southern District of West Virginia.
